Selling lingerie in Texas

LUBBOCK, TX — An obscure law sends one local lingerie store clerk to jail. And now she may forever have to register as a sex offender.
The lingerie store, Somethin’ Sexy was raided by police last week for violating Lubbock`s sexually oriented business ordinance.

  2. Funny thing is… the lingerie shop knew of the law long ago

    Yes its an old law, but it has been in the public eye for awhile (happened in alabama too)

  3. Indeed, Lord Nazh, and even if the shop didn’t know of the law, that’s no defence, though there is the principle, de minimis non curat lex.
    Still sounds a bloody stupid law, though, and, imprisoning the luckless sales assistant and requiring her to register as a sex offender is both draconian and an utter waste of everyone’s time and money.

    “If they tell them this is a candle put in on the birthday cake this is a novelty if they tell you to use it to enjoy sexual gratification, its no longer a candle on the birthday cake” says Assistant D.A. John Grace.
    What’s illegal and what’s not when it comes to sexual devices comes down to marketing and intentions.
    “If the seller is selling it as a novelty and the buyer is buying it as a novelty to make fun of, then it probably has not reached the level of an obscenity” says Grace.

    Honestly, don’t the police and criminal justice system in Lubbock, Texas, have better things to worry about?

  4. anytime a system is inidated (sp?) with beaurocrats, then it becomes broke :)

    There is a law on the books in OKLAHOMA that says it is illegal to kill whales….

  5. And it certainly seems to have worked, Lord Nazh; I bet there hasn’t been a single whale killed there since it was passed. A bit like our law against causing nuclear explosions, which wasn’t a specific offence until Mr Blair wisely prohibited it in the Nuclear Explosions (Prohibition and Inspections) Act 1998
